Protecting the Fundamental and Privacy Rights of the Citizens of Wyoming

The Wyoming Supreme Court issued a decision holding the Wyoming Constitution includes a fundamental right to health care, (applying strict scrutiny) and that Abortion is a necessary component of women’s health care and the decision to terminate or continue a pregnancy is a woman’s own health care decision. John Robinson and Marci Crank Bramlet have been advocating for these rights for Wyoming’s women since this case began in 2023.
Among the many important comments of the Court, Chief Justice Lynne Boomgaarden holds:
- “We Overrule the ‘No-Set-of-Circumstances’ Distinction between Facial and As Applied Constitutional Challenges to Statutes”
- Ignoring legislative facts and other extrinsic evidence asks a Court “to put blinders on” when applying strict scrutiny to fundamental rights
- Abortion is necessary medical care, including on the basis of mental health conditions
- Rape and incest exceptions undermine the State’s stated interest of protecting unborn life, and actually create a barrier to victims of violence seeking necessary health care
